Kevin Agatep, 33, who was previously arrested following an incident outside the Ritz Cafe in Oak Bluffs where he allegedly assaulted a man in July and paralyzed the victim from the waist down, was arrested for separate charges, involving the distribution of cocaine, late last month.
Agatep was released on personal recognizance for his charges from the alleged assault that left Daniel Serusa with serious injuries. As a result of his most recent arrest in August, involving cocaine distribution, he will be held for up to 90 days at the Dukes County Correctional Facility, without the possibility of bail.
“Bail can be reargued at the end of the 90-day revocation,” Casey Dobel, Agatep’s defense attorney, told The Times.
According to a police report, Oak Bluffs officers saw Agatep on August 31 at roughly 4 am “rapidly mumbling incoherently and making strange, erratic movements with his hands, head, and body” near Nancy’s Restaurant on Oak Bluffs Harbor. The report states he was shoeless and wearing an ankle monitor.
After the officers questioned Agatep, they believed he might be high on cocaine, according to the report. Police reported Agatep claimed he was not on any drugs, and was not harmful to himself.
“Agatep was not slurring his speech, and no odor of alcoholic beverages was present,” the police report said. “Although his behavior was strange, officers did not believe he was a danger to himself, and believed he was only high on cocaine or another stimulant. After some time trying to convince him to go to the hospital, Agatep was allowed to go on his way.”
At 5:44 am, according to the report, officers were dispatched to public restrooms on Kennebec Avenue after receiving a call of a male harassing women.
When officers arrived on scene moments later, Agatep was in front of the restroom. Agatep admitted he was on cocaine, according to the report. Agatep eventually was taken in an ambulance, and officers searched the bathroom and found a “white, powdery substance consistent with cocaine on the counter,” the report said. Officers tested the substance and found it to be cocaine.
Officers searched Agatep at the hospital, and found $424 and a large glassine baggie with 8.8 grams of a white, powdery substance consistent with cocaine, according to the report.
Agatep was charged with distribution of a class B drug, resulting in the revocation of his $1,300 bail from the incident outside the Ritz Cafe in July and a 90-day holding at the Dukes County Correctional Facility.
