Edgartown hires outside counsel for pool bar case


Edgartown has retained outside counsel in a case involving the zoning board of appeals in relation to a pool bar dispute between the Harbor View Hotel and several of its neighbors. Reynolds, Rappaport, Kaplan & Hackney director Michael Goldsmith previously represented the zoning board in the case. The switch-up was a decision made by town counsel, according to Edgartown town administrator James Hagerty. 

James Lampke of the Hingham firm Lampke and Lampke told The Times his firm intends to formalize its representation of Edgartown with the superior court this week. Lampke serves as town counsel for Hull, and does special counsel work for other municipalities. The pool bar has already seen legal action. A preliminary injunction filed on behalf of those neighbors that aimed to halt construction of the pool bar and to forbid its use was denied by Judge David Ricciardone on June 25. However, a superior court case connection to the injunction remains active. An appeal of the building permit was denied by the Edgartown zoning board on July 31.
